We do not knowingly collect, solicit data from, or market to children under 18 years of age, nor do we knowingly sell such personal information. By using the Services, you represent that you are at least 18 or that you are the parent or guardian of such a minor and consent to such minor dependent’s use of the Services.

If we learn that personal information from users less than 18 years of age has been collected, we will deactivate the account and take reasonable measures to promptly delete such data from our records.

9. Controls for DO-NOT-TRACK features

Most web browsers and some mobile operating systems and mobile applications include a Do-Not-Track ("DNT") feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. At this stage, no uniform technology standard for recognizing and implementing DNT signals has been finalized. As such, we do not currently respond to DNT browser signals or any other mechanism that automatically communicates your choice not to be tracked online.

If a standard for online tracking is adopted that we must follow in the future, we will inform you about that practice in a revised version of this Privacy Notice.

California law requires us to let you know how we respond to web browser DNT signals. Because there currently is not an industry or legal standard for recognizing or honoring DNT signals, we do not respond to them at this time.

We do not collect or process sensitive personal information for the purpose of inferring characteristics about you.

We may also collect other personal information outside of these categories through interactions such as support requests, surveys, or contests. We retain information as long as necessary to provide our Services or for business and legal compliance purposes.

Your Rights

Depending on your state of residence, you may also have additional rights such as access to lists of third parties with whom your data was shared or the right to limit sensitive data use.

You may designate an authorized agent to make a request on your behalf. We may require verification of your identity and the agent’s authority before processing the request.

Appeals and California “Shine the Light” Law

If we decline to act on a request, you may appeal our decision by emailing info@lunahealthdpc.com . If your appeal is denied, you may file a complaint with your state attorney general.

California Civil Code Section 1798.83 (“Shine the Light”) permits California residents to request information once per year regarding personal information disclosed for direct marketing purposes. 11. HIPAA Privacy Policy - Notice of Privacy Practices

This notice describes how medical information about you may be used and disclosed and how you can access this information. Please review it carefully.

Luna Direct Primary Care, P.C. is committed to protecting your health information. We are required by law to maintain the privacy of your Protected Health Information (PHI) and to provide this notice explaining our legal duties and privacy practices. This notice is effective as of January 1, 2011, and applies to all PHI we maintain, whether in paper, electronic, or other formats.

How We Use and Disclose Your PHI

Luna Direct Primary Care, P.C. uses your PHI for purposes related to treatment, payment, and healthcare operations:

All staff with access to PHI are required to sign a confidentiality agreement and receive training on our privacy practices. Access to PHI is limited to only the minimum necessary to perform their duties. Files are stored securely, and computer systems require staff-only passwords and screen protections.

Our Commitment to Your Privacy

All patient PHI is stored securely during and outside of business hours. Confidential information is never discussed in public areas, and any visible screens displaying PHI are shielded from unauthorized view. Staff members may only access the PHI needed for their specific roles. Only authorized personnel may access patient records.

Notice of Privacy Practices Availability

A copy of our Notice of Privacy Practices is available at any Luna Direct Primary Care, P.C. office and may also be requested or reviewed on our website. We reserve the right to amend this notice. Changes will be posted in our office and online with a revised effective date.

Your Rights Regarding Your PHI

Appointment Reminders and Communication

We may contact you directly or through a business associate to remind you of appointments or to share treatment options, health benefits, or services that may be of interest. Contact may occur via phone, voicemail, email, postcard, or letter unless you instruct us otherwise.

Business Associates

We may work with contractors or vendors who require access to PHI in order to perform services on our behalf. These business associates are required by contract to safeguard your information. If we identify a pattern of noncompliance, we will take corrective action, including possible termination of the agreement.

Complaints

If you believe your privacy rights have been violated, you may file a complaint with our Privacy Officer at Luna Direct Primary Care, P.C., or with the U.S. Department of Health and Human Services, Office for Civil Rights. You will not face retaliation for filing a complaint.
